Upon making an appointment with a our Tulsa bankruptcy lawyer from The Colpitts Law Firm, you will need to bring a good understanding of the property you own, the debts you owe, and your income. You should bring your most recent pay stub and tax return. Prior to your consultation, we will have you complete a short intake form regarding your property, debts, and income. We will go into those items in more detail during the meeting.
If you choose to move forward with filing bankruptcy, you will need to be prepared to provide the following documents and information:
- Pay stubs or other documents evidencing your income for the past 6 months – this includes any non-wage income such as Social Security, public assistance, spousal maintenance, trust account funds, and retirement account funds.
- Copies of your tax returns for the past four years
- Most recent statements from all your creditors, which includes their addresses, amounts still owed, and account numbers
- Bank statements for the past 6 months
- A list of your monthly expenses
- Driver's license or government-issued photo ID
- Copies of the summons, complaint, and court order if you have been sued or your wages have been garnished
You will also provide a list of your assets including:
- Automobiles, including the amount owed and market value
- Money that is owed to you, including tax refunds
- Jewelry and value
- Life insurance policies
- Retirement accounts such as an IRA, 401K, or pension
- Checking and savings account numbers and amounts
- Antiques or items of unusual value
- Firearms
- Electronics
- Boats
- Real estate
- Certificates of Deposit (CDs) and annuities
- Stocks
Some of the documents above may not apply to you, but that is up to your attorney. Additionally, after your initial consultation, we will provide you with a longer questionnaire, called an Organizer, where you will list all of your property and debts in more detail, as well as answer other questions. You may complete this either by hand or online. It can take time to obtain these documents and fill out the questionnaire, but time may not be on your side so it is important to complete the questionnaire and provide the documents as quickly as you can. By bringing these documents and completed questionnaire to our office, your attorney can more easily assess which type of bankruptcy is your best option, if at all.
If more documents are needed, your bankruptcy lawyer will advise you. That said, if you have the items in this checklist with you, then most if not all of your petition can be prepared very quickly.
